1. Introduction
These Terms & Conditions (the “Terms”) govern your access to and use of the Paymitraa website and the partner services made available through it by Shri Dariyav Doorstep Services Private Limited, the company behind Paymitraa (“SDDS”, “we”, “us”, or “the Company”). They apply to every visitor to the website and to every registered partner, whichever layer of the network they belong to.
If you do not agree with any part of these Terms, please do not use the website or the services.
2. Definitions
- Website
- The Paymitraa website and any pages, forms, or interfaces made available under it.
- Services
- The assisted banking, payment, recharge, ticketing, tax-support, and related facilities offered through the Paymitraa network.
- Partner
- A registered user operating in one of the network roles — Retailer, Distributor, or Subsidiary.
- Account
- The credentials and access granted to a Partner following registration and activation.
- Customer
- An end user who receives a Service at a Partner’s counter.
- Content
- Text, graphics, data, code, and other material made available on the Website.
3. Acceptance of Terms
By accessing the Website, registering for an Account, or using any Service, you confirm that you accept these Terms and agree to be bound by them. If you accept these Terms on behalf of a business, you confirm that you have the authority to bind that business.
You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872 in order to register as a Partner.
4. Use of the Website
You may use the Website for lawful purposes only. You agree not to:
- use the Website in a way that breaches any applicable law or regulation;
- attempt to gain unauthorised access to any part of the Website, its servers, or any connected system;
- interfere with or disrupt the integrity or performance of the Website;
- introduce malicious code, or attempt to probe, scan, or test the vulnerability of any system;
- copy, scrape, or systematically extract Content without written permission;
- misrepresent your identity, role, or affiliation with the Company.
5. User Accounts
Access to Services requires registration and activation. When you register you agree to provide accurate, current, and complete information, and to keep it up to date.
5.1 Credentials
You are responsible for maintaining the confidentiality of your credentials and for all activity that takes place under your Account. Do not share your password or any one-time passcode with any person, including anyone presenting themselves as Company staff or as your Distributor.
5.2 Verification and approval
Registration does not by itself create an active Account. Activation follows verification, and sensitive actions on an Account may require verified approval before they take effect. The Company may decline, suspend, or revoke an Account where verification cannot be completed or where these Terms are breached.
5.3 Notification
You must notify us without delay if you become aware of any unauthorised use of your Account or any other breach of security.
6. Products & Services
The Services available to a Partner depend on that Partner’s role, location, and completed verification. Availability is not uniform across the network and may change.
Service descriptions on the Website are provided for information. The Company may add, modify, suspend, or withdraw any Service, in whole or in part, at any time. Where a Service is delivered by or depends on a third party, that third party’s own terms and operating conditions may also apply.
Specific service scope, eligibility criteria, and operating limits differ by role and Service, and are confirmed with the Partner by the support desk at onboarding.
7. Payments and Billing
Commercial terms — including any charges, commissions, margins, credit arrangements, and settlement cycles — vary by role, Service, and volume, and are confirmed with the Partner as part of onboarding rather than published as a single rate card.
- Settlement cycle — the settlement cycle for eligible transactions is confirmed with the Partner at onboarding.
- Refunds and chargebacks — for a failed transaction, the reversal depends on the status confirmed by the bank or provider, and is completed within the timelines prescribed by RBI, NPCI and the bank or provider concerned.
- Taxes and statutory deductions — GST and TDS apply to commission as per applicable law.
No figure should be treated as agreed unless the Company has confirmed it to you in writing.
8. User Responsibilities
As a Partner you agree to:
- operate only the Services activated for your role and location;
- comply with all applicable laws, regulations, and operating requirements that apply to the Services you deliver;
- deal fairly with Customers, and provide receipts or transaction records where applicable;
- maintain accurate records of transactions carried out at your counter;
- not use the Services for any unlawful purpose, including money laundering, fraud, or the financing of prohibited activity;
- not represent yourself as an employee or agent of the Company beyond the role granted to you;
- report suspected fraud, misuse, or a security incident to the support desk without delay.
9. Intellectual Property
The Website and its Content, including the Paymitraa name, logo, design, text, graphics, and software, are owned by or licensed to the Company and are protected by applicable intellectual property law.
You are granted a limited, non-exclusive, non-transferable, revocable right to access and use the Website and Content for the purpose of using the Services. No other right or licence is granted. You may not reproduce, distribute, modify, or create derivative works from the Content without prior written permission.
Trade marks or logos of third parties shown on the Website remain the property of their respective owners.
10. Third-Party Services
Certain Services rely on banking partners, payment networks, and other third-party providers. The Website may also contain links to third-party sites.
The Company does not control and is not responsible for the content, availability, security, or practices of any third party. Your dealings with a third party are between you and that third party, and may be governed by their terms and privacy policies. The inclusion of a link or an integration does not imply endorsement.
11. Privacy
Our handling of personal information is described in the Privacy Policy, which forms part of these Terms. By using the Website or the Services you acknowledge that information will be handled as described there.
12. Disclaimer
The Website and the Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, the Company makes no warranties or representations, express or implied, as to the operation of the Website, the accuracy or completeness of the Content, or the availability, continuity, or uninterrupted performance of any Service.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
13. Limitation of Liability
To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profits, revenue, business, goodwill, or data, arising out of or in connection with your use of the Website or the Services.
The Company’s aggregate liability arising out of or in connection with these Terms is limited as per applicable law and the specific commercial terms agreed with the Partner in writing.
This section is subject to Section 12 and to any liability that cannot lawfully be excluded.
14. Indemnification
You agree to indemnify and hold harmless the Company, its officers, employees, and authorised representatives against any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Website or the Services, your breach of any applicable law, or your infringement of the rights of any third party.
15. Termination
The Company may suspend or terminate your access to the Website or to any Service, with or without notice, where it reasonably believes that these Terms have been breached, that verification cannot be completed, that a Service is being misused, or that suspension is required by law or by a banking or regulatory partner.
You may stop using the Website at any time and may request closure of your Account by contacting the support desk. Termination does not affect rights or obligations accrued before it takes effect. Sections 9, 13, 14, and 17 survive termination.
When an Account is closed, the Company first reviews the reason for closure. Where no objection or dispute is outstanding, any pending settlement amount is paid as per the agreed settlement terms, and records are retained for as long as required by law.
16. Changes to Terms
The Company may update these Terms from time to time. The revised version takes effect when published on this page, and the “Last updated” date at the top will be changed accordingly. Where a change is material, the Company will take reasonable steps to notify registered Partners.
Your continued use of the Website or the Services after a change takes effect constitutes acceptance of the revised Terms.
17. Governing Law
These Terms and any dispute arising out of or in connection with them are governed by the laws of India, and the courts at Bikaner, Rajasthan shall have exclusive jurisdiction, without regard to conflict-of-laws principles.
Before starting any legal proceeding, both parties will first try to resolve the dispute through mutual discussion between the Partner and the Company’s support desk.
